ALLEGED OFFENCE :
Commission of a Crime Against Peace under the Common Law and against the Peace of the Realm, in that
(i) the accused Person has participated and assisted in the planning and preparation of, and has participated in and prosecuted a common plan for the initiation and waging of, and has now so initiated and is now so waging,
a War of Aggression and in violation of international treaties, agreements and assurances ;
(ii) the said conduct constitutes the commission of a Crime Against Peace , under international customary humanitarian law of armed conflict, as described, instanced and set out in Article VI(a) of the Principles of International Law settled by the Statutes and Judgement of the Internal Tribunal for the Punishment of War Crimes at Nuremberg, as in turn formulated by the International Law Commission of the United Nations and unanimously affirmed by
the General Assembly of the said Organisation (in Resolution 95 of the First Assembly 1946) ;
(iii) the said crime is, furthermore, a violation of the fundamental and peremptory norms of international customary humanitarian laws of armed conflict, and as such is against and contrary to the jus cogens and thus is inexcusable, unjustifiable and unpardonable in all circumstances ;
(iv) the said elements of international customary humanitarian laws of armed conflict, forming a part of the customary laws of civilised nations, is adopted by and thus embraced within the Common Law of the Realm for England and Wales and thereby falls within the juridical jurisdiction of the Court.

STATEMENT of PARTICULARS
That the Accused Person, being the incumbent holder in title of the Office of Her Majesty’s Prime Minister and First Lord of the Treasury has, whether in purported colour of the exercise of his Official Capacities, or otherwise, sought, by himself and/or in co-operation with others in pursuit of a common plan or agreement, to charge, command, order, dispose, enjoin, organise, initiate, and otherwise procure, various components of the Armed Forces of the Crown to engage in, whether by
themselves, or in conjunction with, or under the command of, the Armed Forces of other Foreign Powers, Potentates and Princes, but most especially those of the United States of America, any and several of the present and ongoing military actions, engagements, and operations etc. by the use of land, sea and air forces, against the Armed Forces, Government, State Organisation and Territory of the Republic of Iraq ; but most especially the adverse and opposed military occupation of and further
aggressive invasion into the Sovereign Territory of the said State of Iraq, being a Full Member of the International Organisation entitled the United Nations, in breach of its territorial integrity and political independence.
That such conduct comprises the prosecution of a War of Aggression, and specifically comprises a Violation of the Charter of the United Nations, Article 2(4) of which provides that
“ All Members shall refrain in their international relations from the threat or use of force against the territorial integrity or political independence of any state, or in any other manner inconsistent with the Purposes of the United Nations. “
